Default Why illigitimate children cannot put nasab on their biological father??

Assalamualaikum, non-Muslim ask this question

'Why muslim put the burden of humiliation to children born out of wedlock by prohibiting them naming their father on the real biological father??? Imagine if the public know that father's name not the same with biological father's name, that will cause humiliation

Can anyone answer this? I found many fatwa says it is haram for illegitimate children to put the real father as their father's name

Wa Alaykom Assalam,

The questioner seems to confuse himself since he mixed many topics together.

Islam does not look down on the child born outside the bond of marriage, thus to claim otherwise is farfetched baseless claim. As a matter of fact, every illegitimate child has equal rights and responisbilities just like any one else. Islam dictates that the only persons who should be ashmed and deserving for humiliation is the adulterers alone. Yet, inspite of that, Islam shows mercy to sinners as it states it is unlawful for people to ashame people of a sin they repented from.

The aforementioned shows everyone that the problem today is not with the regulations of Islam but rather people make the problem when their cultures and mentalities oppose ethic code of Islam.

The most simple example to explain the above is the case of homosexualities; the Abrahamic religions (Islam, Christianity and Judaism) condemn this disgusting act while some western cultures today consider it is ok to be gay!!! So, whose fault here? religion or people? The answer is clear.

The above should give the answer to the questioner. The text below is for Muslims to understand and not to investigate or look into but just a general knowledge, kind of.

As for the issue of whether illegitimate children can have their fathers name. This is a very detaile issue as each case is different and so would be the ruling. In some cases, the illegitimate child can take his bioligical father according to some scholars.

Syeikh, can you help us by quoting scholars who permit this and in can you elaborate more on the cases permitted

I found some articles said it is a consensus among fuqaha prohibiting this

I apologise but I will not offer any help in this regrad. The only reason I mentioned it is just so Muslims understand that there is nothing called general ruling and so only qualified judge and Mufti is able to issue a verdict depending on the circumstances of each case. That said, no Muslim should look into this or even bother about it.
